1. Who we are

Lummes is an AI-powered facial skincare companion that provides weekly skin analysis (LUM Day), personalized routines, and progress tracking over 30-day cycles (LUM Mes).

2. Eligibility & accounts

• You must be at least 13 years old (or the age required by your jurisdiction) to use the app. If you are under 18, you must have parental consent.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Provide accurate information and keep it up to date.

3. App licenses & store terms

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on a device you own or control, as permitted by the Apple App Store or Google Play terms.
• Apple-specific: Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event of any failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple is a third‑party beneficiary to these Terms regarding your use on iOS devices.
• Google-specific: Your use of the app via Google Play is subject to Google Play Terms of Service and policies.

4. Subscriptions, trials, and billing

• Certain features require a paid subscription (Weekly or Yearly). Prices and currencies are shown in-app and may change.
• Subscriptions auto‑renew unless canceled at least 24 hours before the end of the current period.
• Free trials convert to a paid subscription unless canceled before the trial ends.
• Billing, renewals, cancellations, and refunds are managed by Apple or Google. To cancel, use your App Store or Google Play subscription settings. We cannot process store refunds directly.
• Taxes may apply based on your location.

5. User content and acceptable use

• You may upload photos and input preferences solely for your personal use of the app.
• Do not post or upload content that is unlawful, infringing, harassing, hateful, or violates privacy or publicity rights.
• Do not reverse engineer, decompile, scrape, or attempt unauthorized access to the app or our systems.

6. AI guidance disclaimer

Insights and recommendations are informational and for cosmetic/wellness purposes only; they are not medical advice. For medical skin conditions or emergencies, consult a licensed dermatologist or physician.

7. Device permissions & communications

• We may request camera, photo library, and notification permissions to enable core features (e.g., LUM Day photos and reminders). You can change permissions in your device settings.
• By enabling push notifications or email, you consent to receive in‑app reminders and service messages. You can opt out in settings.

8. Privacy & data deletion

• Our Privacy Policy explains how we collect, use, and share information.
• Data Deletion Policy: You can request deletion of your account and associated personal data at any time from within the app (Account → Settings → Delete Account) or by emailing info@lummes.app. We will process verified requests within a reasonable timeframe, subject to legal retention obligations.

9. Intellectual property

• The app, AI models, text, graphics, logos, and software are owned by Lummes and protected by intellectual property laws.
• You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Third‑party services

The app may integrate third‑party services (e.g., analytics, crash reporting, cloud storage). Your use of such services may be subject to their terms and privacy policies.

11. Warranty disclaimer

The app is provided on an “as‑is” and “as‑available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the app will be uninterrupted, secure, or error‑free.

12. Limitation of liability

To the maximum extent permitted by law, Lummes will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or loss of data, revenue, or profits, arising from your use of or inability to use the app.

13. Indemnification

You agree to indemnify and hold harmless Lummes and its affiliates, officers, and employees from any claims, damages, liabilities, and expenses arising from your use of the app or violation of these Terms.

14. Governing law & disputes

These Terms are governed by the laws of your jurisdiction. Where permitted, disputes will be resolved through binding arbitration or small‑claims court, and class actions are waived. You may have additional rights under mandatory local law.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you by updating the date at the top, in‑app notice, or email. Continued use after changes means you accept the updated Terms.
